Trump asks Supreme Court to reinstate the travel ban

President Trump's lawyers asked the Supreme Court late Thursday to revive his temporary ban on foreigners arriving from six majority-Muslim nations, setting the stage for a potentially far-reaching ruling on the president's power to control immigration.

Last month, the 4th Circuit Court of Appeals largely affirmed a federal judge's decision from March, which found the core provision of the revised executive order - temporarily blocking foreign nationals from six Muslim-majority countries from entering the U.S. - likely violates the Constitution because its primary objective was to disfavor Muslims.

The Justice Department says in court filings that lower courts blocking the ban made several mistakes, including relying on statements President Donald Trump made during the 2016 campaign.

In its Supreme Court filing, the Justice Department complains, "Respondents barely mentioned any of these provisions in seeking to restrain the Order".

In order to hear the case, the Supreme Court would now have to grant certioari - or accept the case - by having four of its nine justices vote in the affirmative. But it is not certain that the justices would break down along ideological lines.

The travel ban case will probably be handled as an emergency matter by the high court. They say the Constitution makes clear that federal executives control immigration, while immigration laws say the president may "suspend the entry of all aliens or any class of aliens" if he thinks they "would be detrimental to the interests of the United States". That case is now awaiting an appeal at the U.S. Court of Appeals for the 9th Circuit.

Department spokeswoman Sarah Isgur Flores says the ban is lawful.

If successful, the travel ban could be reinstated within a few weeks. The Justice Department is arguing to the Supreme Court that the lower courts erred in taking into consideration Trump's vow, as a candidate, to ban Muslims from the US, saying that he has now sworn to uphold the Constitution so his campaign statements don't count.

The appeals court said Trump's comments showed the policy was "steeped in animus and directed at a single religious group".

It would take five justices to agree to the stay application.

To resolve that question, the Supreme Court would have to decide whether the president has the final word on the rules for admitting foreigner visitors, immigrants and refugees. "They would also consider whether" irreparable harm" will result from the denial of they stay.

In March, Trump issued a narrower order, but federal courts that have examined it so far have blocked it as well.
