Officer justified in firing at motorist

Jurors heard testimony from several witnesses this week and are expected to begin deliberations Monday after final arguments.

On the squad auto video, Castile can be heard saying, "I'm not pulling it out", as Yanez opened fire. Only 12 will deliberate, with three serving as alternates. Yanez watched a video of two black men with guns and was told to be on alert for the suspects.

He told the jury that Castile stared straight ahead and had "total disregard" for the officer's commands to stop reaching for the firearm Castile had just seconds before disclosed he was carrying in the auto.

Castile died, insisting that he hadn't been reaching for his handgun. Paulsen noted the absence of a bullet hole in Castile's shorts or bullet damage to his gun - evidence, the prosecutor said, that showed he wasn't reaching for the gun when shot.

"Correct, but it doesn't always mean that's what he was doing", Yanez said. Castile's girlfriend, Diamond Reynolds, live streamed the aftermath of the encounter, showing his bloody death.

"He didn't tell me where the (expletive) gun was", Yanez said, according to the Associated Press.

A Minnesota police officer charged with manslaughter in a black motorist's death is explaining how he came to pull the man's auto over. Yanez had pulled the 32-year-old cafeteria worker over because of a faulty brake light, after following him for 2 miles before activating his lights and sirens in July 2016.

Yanez told the jury the reasons why he stopped Castile on that July 6 night - that his description fit that of a robbery suspect, an incident he responded to on July 2.

Seventy-four seconds is the amount of time that elapsed between the moment Yanez turned on his squad auto lights to the moment he fired the seventh and final shot into Castile's vehicle. Witnesses have testified that the gun was in a pocket of Castile's shorts when paramedics removed him from his vehicle. He says he clearly saw the metal of the gun before he fired seven shots, hitting Castile five times.

Earlier Thursday, St. Anthony Police Chief Jon Mangseth testified that the shooting might have been justified even if the officer couldn't see the gun. The exchange took just over a minute and Castile's permit to carry a gun was later found in his wallet.

He also questioned why he failed to give Castile clear commands, such as "don't move", or telling him to keep his hands on the steering wheel as officers are trained to do when they learn a driver has a firearm, especially if they become concerned about the person's movement.

The officer testified when he saw Castile's gun, "my family popped into my head".

Yanez said he meant to tell investigators that he saw the top of the slide, on the back part of the gun, rather than the barrel. "I told him to get his hand off it!"

Dutton added that Yanez's ability to accurately describe Castile's handgun after the shooting indicated he told the truth.

KARE 11's Lou Raguse has been in the courtroom since the start of the trial, and says jurors could be seen taking detailed notes during Kapelsohn's testimony about his experiment.

The shooting in the St. Paul suburb of Falcon Heights, like similar incidents across the United States, fueled public debate about appropriate use of force by law enforcement against minorities.

He was the second use-of-force expert to testify on behalf of the defense. He rejected prosecutor Jeff Paulsen's assertion Friday that the central question in the case is whether Yanez saw Castile's gun.

Emanuel Kapelsohn was the second such expert in two days called by attorneys for Officer Jeronimo Yanez. Castile handed over his insurance card and then told Yanez, "Sir, I do have to tell you, I do have a firearm on me". Kapelsohn says that was a moderate response.

"When he was reaching, he looked straight ahead, continued to reach towards his pocket", Yanez told the jury.

Yanez is expected to take the stand in his own defense Friday afternoon.

The state rested its case against Yanez on Thursday morning.

Both the prosecution and defense also called use-of-force experts to testify on behalf of their side.

Officer Yanez now faces charges of manslaughter and reckless discharge of a weapon and is on trial before a jury in Minnesota. Yanez said it was implied.
