Trump travel ban dealt new legal defeat

The court's decision follows a ruling last month by a Virginia appeals court that upheld a nationwide injunction against Trump's revised executive order, which was created to better withstand legal scrutiny after the first failed at the federal court level. The ruling from a three-judge panel of the Ninth Circuit Court of Appeals is yet another stinging loss from a court that similarly refused to reinstate Trump's original executive order on travel in February.

Similar records are turned over to the National Archives and the Records Administration after a president's tenure is through. Trump's comments have caused his aides to be unable to provide a definitive answer.

Several states and civil rights groups also challenged the revised ban, saying it remained rooted in discrimination and exceeded the president's authority.

Mr Trump has repeatedly said that the ban is necessary to protect Americans from terrorism.

Court largely upholds block on Trump's revised travel ban
However, the 9th Circuit did rule that the preliminary injunction - as originally imposed by the district court - was too broad. The ban has been blocked on the grounds that it violates the Establishment Clause of the Constitution by disfavoring Muslims.

The Ninth Circuit ruled against the implementation of the ban on Monday, citing a Trump tweet from last Monday, June 5. The court said Watson should not have barred the administration from conducting an internal review to assess its vetting procedures.

The state of Hawaii, one of the jurisdictions challenging the ban, said in court papers filed Monday before the Supreme Court that Trump's order had had "staggering" consequences.

"I think we can all attest that these are very risky times and we need every available tool at our disposal to prevent terrorists from entering the United States and committing acts of bloodshed and violence", Spicer said.

Lawyers for the state of Hawaii, meanwhile, told the Supreme Court on Monday that it should not allow the administration to proceed, again describing his order as a "thinly veiled Muslim ban". The ruling affirmed the majority of a district court injunction [JURIST report] that blocked the order from being enforced. Trump described the order, which replaced an earlier January 27 order that also was blocked by courts, as a "watered down, politically correct" version of his original plan.
