Justices could take up high-stakes fight over electoral maps

In the Wisconsin case, a federal court struck down the districts as unconstitutional in November, finding they were drawn to unfairly minimize the influence of Democratic voters.

The action was announced in a list of orders that the court issued Monday.

"No matter which side of the aisle you're on, we should all be able to agree on one thing: as voters in a democracy we should have the right to freely choose our representatives rather than endure a system where politicians manipulate our district lines, dilute our votes, and choose their own constituents", Johnson said.

The challenge to Wisconsin's legislative lines are different because the challenge revolves around whether district lines can be drawn for a partisan advantage.

A three-judge court struck down Wisconsin's legislative districts in November and ordered new maps drawn in time for the 2018 elections.

Legislative boundaries get redrawn every decade after the U.S. Census to make sure they're equal in population, but when one party controls all of state government as Republicans did after the 2010 wave election, they can draw maps that give themselves a partisan edge. Their Assembly lines were so effective that Republicans won a commanding majority in the chamber in 2012 even as Obama won Wisconsin by 7 points and Democratic legislative candidates won more votes statewide than Republicans did. Others say courts should step in. In a 2004 case on the same topic, Justice Anthony Kennedy, as the deciding vote, refused to strike down the map in question on the basis that it represented an unfair partisan gerrymander.

Burden noted that because the Wisconsin case only deals with state legislative districts, separate litigation would be needed to deal with the way congressional districts are drawn.

The justices could say as early as Monday whether they will intervene.

"The court is surely aware that this decade produced some of the most aggressive partisan gerrymandering in the modern era", Pildes said. By its order, the Supreme Court has apparently chose to take the case in its next term, calling it officially a postponement of a decision on jurisdiction. The state is one of several battlegrounds where Republicans and Democrats fought to a virtual draw in last year's presidential election, but where Republicans enjoy election districts that have given them a almost 2-to-1 advantage in the state Assembly. But they have all the levers of power in just six states; Republicans control 25 states, with 197 of the 435 seats in the House of Representatives.
