Trump not under investigation in Russia probe - lawyer

Sen. Marco Rubio says it's best for the country to let the FBI's investigation into Russian Federation meddling in the 2016 presidential election take its course, and the Florida Republican tells CNN's "State of the Union" that's what he'd advise President Donald Trump.

But Jay Sekulow, part of Trump s legal team, said the president was writing about reports of an investigation, not an actual probe.

Sekulow said it was a response to an article in the Washington Post alleging Trump was under investigation for obstruction of justice.

Days after Comey was abruptly ousted, Rosenstein appointed Robert Mueller as special counsel to investigate Russian involvement in the 2016 presidential election and possible collusion with the Trump campaign.

Trump ally Newt Gingrich said Sunday that he began to grow skeptical of Mueller after fired Federal Bureau of Investigation director James Comey testified that he had leaked details about his conversations with the president in order to prompt the appointment of a special counsel.

But after harping on it, and asking about Deputy Attorney General Rod Rosenstein, Sekulow, appearing to refer to that story again, explained the president's position.

Asked if Trump's social media commentary may be created to intimidate Rosenstein or Mueller, Senator Marco Rubio said "I have no basis to make a decision on what his intent is" but added that the tweets "in no way" will impede the work of the investigation.

Not surprisingly, most of the hosts interviewing Sekulow on Sunday morning started by taking the president at his word that he is "being investigated".

Separately, a former White House lawyer, who spoke on condition of anonymity, said there was nothing stopping Trump or his lawyers from asking Mueller whether Trump was under investigation. The Washington Post or one of President Trump's attorneys? I would say the answer is yes, for a number of reasons.

The White House has directed questions for details to outside legal counsel, which has not responded.

"This is the first time the president's overall approval rating has hit the 50% mark since late April", the site states.

"The fact of the matter is the president has not been and is not under investigation. I'm just curious, why doesn't the president embrace this investigation if he's innocent?"

The lawyer also said it was unlikely that any obstruction probe would not examine Trump. But America's laws today are a web in which even the most innocuous citizen can get tangled-a citizen who has business dealings with figures as corrupt as many Russian businessmen and officials tend to be is nearly certainly open to prosecution on one technicality or another, as is anyone who talks to federal investigators and tells even the smallest of lies.

Rosenstein could eventually be questioned by Mueller about his memo on Comey and what motivated Trump to ask him to write it.
