Supreme Court will consider suit against anti-discrimination laws

The legal tumult began in 2012, when Jack Philips, the owner of Masterpiece Cakeshop in Lakewood, Colorado, a suburb of Denver, refused to create a cake for David Mullins and Charlie Craig - who were Wednesday in MA but planned to have a reception in the Rocky Mountain state.

The case was result of Charlie Craig and David Mullins, a same-sex couple, asking Jack Phillips, the owner of Masterpiece Cakeshop, to design and produce a wedding cake in 2012 for their same-sex wedding in MA.

Phillips argues that his First Amendment rights should protect him from Colorado's anti-discrimination act. The state law now states that businesses open to the public may not deny service to customers based on their race, religion, sex or sexual orientation.

The Supreme Court had considered whether to hear the Phillips case for weeks.

"This case actually involves the exact concerns that Lambda Legal raised during the confirmation hearings for newly-installed Supreme Court Justice Neil Gorsuch about his Court of Appeals opinion in the Hobby Lobby case, in which he ignored Supreme Court precedent and catered to the religious beliefs of employers, trumping federal law and not even acknowledging the harmful impacts on workers".

"Neither should CADA ban Jack Phillips' polite declining to create a cake celebrating same-sex marriage on religious grounds when he is happy to create other items for gay and lesbian clients", his lawyers wrote.
