India to Submit 'Memorial' to ICJ in Jadhav Case on Wednesday

The International Court of Justice (ICJ) will resume hearing in the Kulbhushan Jadhav case, today.

The president of the ICJ, principal judicial organ of the United Nations (UN), had fixed time limits for the filing of the initial pleadings in the case.

It was then decided that India would file its written submissions - or "memorials" - on September 13, and that Pakistan would file a response by December 13. The order was made after taking into account the views of the parties, said an ICJ statement.

A former Indian naval officer, Kulbhushan Jadhav was sentenced to death by a court in Pakistan earlier this year on charges of being an Indian spy.

It will provide details about a passport he had, one he wouldn't have been carrying if he were a spy, and point out how he was tried secretly in a military court, as opposed to a civil one.

Issuing a stay on Jadhav's execution, the ICJ asked Pakistan to "take all measures at its disposal" to ensure that he "is not executed pending a final judgment of the court" in the case.

Jadhav alias Hussein Mubarak Patel was arrested on March 3, 2016 in a "counter-intelligence operation" from Mashkel area of Balochistan over his involvement in espionage and sabotage actives in Pakistan.

In April 2017, he was convicted by a military court and sentenced to death. "The court will take its decision". It maintained that the ICJ need not intervene as it had adhered to a 2008 bilateral treaty with India that supersedes the Vienna pact by stating that the right to consular access can be waived where "national security" is at risk.
