The New York Daily News reported on Saturday, December 2, that lawyers for the former Stanford University swimmer described his first trial as a "detailed and lengthy set of lies" and also claimed that Santa Clara County Superior Court Judge Aaron Persky "neglected to tell jurors to consider lesser criminal charges".

BROCK Turner, the former Stanford university swimmer who was convicted of sexually assaulting an unconscious woman, is appealing his convictions and wants a new trial.

Among the claims in the documents is the notion that the jury in the trial was "tainted" because prosecutors repeatedly stated the assault was committed behind a dumpster.

"His conviction will be upheld", he added. Turner was sentenced in June 2016 to six months incarceration in the Santa Clara County jail, where he served three months before being released. "Nothing can ever roll back (the victim's) legacy of raising the world's awareness about sexual assault".

He added that the United States "has the experience and expertise to help ensure that this process leads to a successful outcome". Ambassador Nikki Haley said the US will continue in its "generosity" by supporting migrants and refugees around the world.

The appeal said the use of the term dumpster "implied moral depravity, callousness and culpability on the appellant's part because of the inherent connotations of filth, garbage, detritus and criminal activity frequently generally associated with dumpsters".

"The cumulative effect of this misleading course of conduct deprived appellant of a fair trial".

Buzzfeed has obtained a copy of the motion, and say that Turner's lawyers are arguing that the jury was not supplied sufficient evidence of Turner's character. That question related to whether digital penetration had occurred.

Stanford law professor Michele Dauber, who is on a committee to recall the judge who sentenced Turner, said it's common for people to appeal.

Records show that Turner's legal team filed their appeal in California's 6th District Court of Appeal.

In response to the Turner case, California lawmakers a year ago passed legislation to broaden the state's legal definition of rape and mandate prison if the victim was unconscious. In the appeal, the lawyers claim the assault did not occur behind a dumpster because the woman was found in a "completely open setting".
