JCP recommends LHC CJ’s elevation to SC

Justice Yawar Ali was one of the members of the Special Court hearing the high treason case against former military dictator General (Redt) Pervez Musharraf for imposing emergency rule in the country in 2007.

The case has gained national importance only recently since BJP President Amit Shah, one of the accused in the Sohrabuddin Sheikh encounter of 2005 in Gujarat Judge Loya was hearing, got discharged by his successor within four weeks of his death in December 2014.

The reassigning of the case to the chief justice's court is being seen as an effort to assuage the concerns of the four dissenting judges.

Now it is up to the CJI to assign this case to another bench, which will be known in the next few days.

The petitions have been filed by social activist Tehseen Poonawala and Maharashtra-based journalist Bandhuraj Sambhaji Lone.

Justices A.K. Sikri, A.M. Kanwilkar and D.Y. Chandrachud are mediating with the four judges and the Chief Justice to hammer out a solution at the earliest, keeping in mind the fact that the judiciary's image was already dented by the unilateral move by the four judges to air their grievances before the media.

Four senior Supreme Court judges - J Chelameswar, Ranjan Gogoi, Madan B Lokur, and Kurian Joseph, held a press conference on 12 Jan, protesting the irrational allocation of sensitive cases by the CJI to benches of his personal preference. The cases were assigned to bench of Justices Arun Mishra and Mohan M Shantanagoudar.

During the meeting, the Commission recommended elevation of Chief Justice Lahore High Court Justice Mansoor Ali Shah to the Supreme Court of Pakistan.

This comes after Justice Arun Mishra recused himself from the case last week.

Last Tuesday, the records came in a sealed cover. At the same time, it indicated that the matter may go to a different Bench on the next date by saying, "Put up before appropriate Bench".

The chairman of the Bar Council of India (BCI) Manan Mishra also said the matter had been laid to rest and the court was back to functioning as before. The CJI on Friday said the case will be taken up by the appropriate bench "as per roster".
